Kenneth Evans, who works at Saks Fifth Avenue store in Beverly Hills, was the first witness to give evidence in the actress's shoplifting trial, which began yesterday. The Oscar nominee, 30, is charged with theft, burglary, vandalism and possession of oxycodone, a controlled drug. Ryder denies all the charges.

Yesterday, Mr Evans told the court in Beverley Hills how he watched Ryder, whose films include Little Women and The Age of Innocence, walking around the store picking up items on 12 December. He watched her closely and saw her pick up a black designer hat and walk around the store with it on her head.

During her shopping expedition, Ryder picked up a variety of items, including hair accessories, socks, a handbag and several designer tops, he said. She also spent time in a changing room as, unknown to her, security guards observed her actions.

Mr Evans said that, at one point, he noticed that Ryder no longer had the black hat on her head but had placed it in her bag.

He told the court: "I was able to see she still had the black hat, it was no longer on her head but was in her bag on top of her red Saks Fifth Avenue shopping bag." Mr Evans added that the film star walked past a number of tills as she headed towards a store exit.

During the hearing, Ryder, who was wearing a long, cream jacket and cream headband, scribbled notes and spoke to her lawyers.

The actress was arrested on the day of her shopping expedition for allegedly stealing about 3,500 pounds worth of clothing from the store.

Police said she was also in possession of the painkiller oxycodone, a morphine derivative, without a prescription.

Ryder's lawyer, Mark Geragos, has said that she was only carrying items between store departments and had a prescription for the drugs.

The actress, who faces up to three years and eight months in prison if convicted, has made fun of her brush with the law, appearing on the cover of an American magazine wearing a T-shirt which had bore the slogan "Free Winona".

The trial continues.
